OP
I agree with Elwin.. and I applaude him for this post and can relate to it indeed! 8)

However, ths is not a prefect world and this is not a perfect utopian site.. so as far as the law is concerned:

If you publish other peoples works without permission, in any media including this site, you can find yourself in trouble. If you also alter anyones works without permission, you will be rosted like a duck and thrown to deviantArt linch mob.

So, although I am a ´confessed´ ripper.. I will stand by the letter of the law to protect the integrity of this site and the artists rights in this debaTE.

:P

I have to say I´m a fan. But Elwin knows that :)

My first skin was The Tick! Still one of my favourites. Heck, I had an incredibly popular Tick Fan Site before I got into skinning!

The problem you get is that when you upload to many skin sites you are saying that you are the original creator of all said graphics (to save the owner of the site from copyright issues). This is a part of the Skinbase Privacy Policy for example:

"By submitting your work to SkinBase, you also agree that you are the legal copyright holder to all said submitted works (or parts-thereof) or that you have permission from the original work´s artist. If a submitted piece of artwork is found to not be that of the submitting artist, he/she shall be responsible for any legal action that may arise due to copyright infringement. We do not claim ownership of the artwork submitted to SkinBase as all artwork submitted is the copyrighted work of its original artist."

I remember when I had my Tick site that there was a lot of noise because FOX were going around the Simpsons fan sites and requesting they be closed down. There was a VERY cool set of icons that FOX apparently wanted taken down from the internet. The Tick was on FOX TV so Tick Fan Sites were possible targets as well. A lot of people didn´t understand as they were not claiming ownership, they were not claiming the work was theirs, they were saying they liked the Tick!

So the only way around it all was to request permission from owners of the original work. I wrote to the people that make the Tick comics many times without one reply. I no longer have a Tick site (online anyhow - kept my files on disc) :)

I did write to www.spawn.com when I made a Spawn skin for Sonique. I got permission from someone there. That was cool. I even got permission for a nude one I did once from the lady´s official website. But having to go through all that just makes you wonder why. It´s easier to make your own graphics and not go through all the drama.

Sad..... I would LOVE a new cool Tick wallpaper ;)

And I thought Elwin´s rant was long! :D

/me hates Tick

Trouble is, with fanskins, you´ll be painfully close to photoskins. one could say there´s a quality threshold in between. Maintaining that threshold woul dbe a very subjective thing.
